This Week, Status Conference For DePuy MDL Will Be Held

When DePuy Orthopaedics initiated the recall of their ASR XL Acetabular System and ASR Hip Resurfacing System, hundreds of recipients have begun filing for individual and class action lawsuits. These two hip replacement implants were discovered to fail within 5 years in 1 in 8 recipients. When one recieves a defective hip implant, he or she would need to undergo a risky and costly revision surgery. Associating complications such as cobalt and chromium poisoning also contribute to the overall difficulty of the second hip replacement surgery. Compensation for monetary and non-monetary losses are being tried to recover by the plaintiffs. The DePuy recall affects 12-13 percent of the 93,000 recipients. All federal lawsuits against the company have now fallen under an MDL ruling.

The case was given to Judge David A. Katz of the U.S. District Court for the Northern District of Ohio in Toledo. In January 20, an initial status conference will be held fpr the purpose of determining which hip replacement lawyers will be assigned to various aspects of the case. Applications for these leadership positions were accepted up until December 23, 2010. Two minutes is all that is given to each attorney for them to be able to state their reasons for wanting the positions.

The purpose of the Multidistrict Litigation is to have ease of access among plaintiffs to relevant pretrial information. Seeing that hundreds have filed for the DePuy lawsuits, MDL ruling would acquire for all partied involved an easier pursuit of the case. Because each case is different from each other, plaintiffs can tailor the information to their individual cases instead of receiving a lump-sum payout that they would get from class action lawsuits. Class action cases would not benefit as much as individual lawsuits would in an MDL.
